Frequently Asked Questions

Conveyancing is the legal transfer of the title of a property and any improvements to that property, from one person to another. Many actions must be undertaken to achieve this and it is essential all paperwork is highly detailed and accurate. In the period between purchase and settlement there are numerous activities we carry out on your behalf.

These include…

  • searches which are ordered to ensure that there are no outstanding interests or problems with the property
  • organising the stamp duty that must be paid to the government
  • the buyer’s loan that must be processed and
  • the seller’s loan which must be discharged.

We make sure you are always fully advised as to where you are in the process and take care of all the legal documentation on your behalf.

We attend to settlement on your behalf and ensure that all required legal documents have been prepared and signed correctly by the required parties and that everything is in order for completion of your matter.

You will require the services of a licensed conveyancer at anytime you enter into an agreement for the sale, purchase or transfer of property.

A land titles register is maintained by the government in each state to centrally record ownership of property. The title is the record of ownership. Today there are still some suburbs that may still need to have ownership proved in this way. This is a very lengthy process which requires proof of ownership dating back for a period of not less than 30 years and thus the services of a competent conveyancing team will be of utmost importance to you. We advise you to keep any documentation you receive, as you might need to provide it when selling your property.

This is the day the representatives of all parties, including any finance providers meet to exchange documents. Final document checks are performed to ensure accuracy and detail, important legal documents are exchanged, and payment of the purchase price is made in full, securing your sale or purchase. Congratulations are in order!

Both can help you with your conveyancing. However a specialist conveyancing firm such as Ishaks will dedicate themselves completely to your conveyancing transaction, as other legal processes do not distract them. A conveyancer specialises in all matters pertaining only to property law.

Your conveyancing will start from the time you enter into your contract of sale or purchase and progress through to settlement.  A standard conveyancing transaction normally takes 42 days (6 weeks) to be completed. The timeframe can be extended or reduced by negotiation between two parties for each transaction.
